This KIRU+ Pro Subscription Policy and End User License Agreement Addendum (“Subscription Terms”) governs the purchase, access, renewal, cancellation, and use of the premium subscription service known as KIRU+ Pro, offered through the KIRU+ mobile application (“App”).

These Subscription Terms are incorporated by reference into the KIRU+ Terms and Conditions of Use and apply in addition to Apple’s applicable terms, including Apple’s Media Services Terms and Conditions and, where applicable, Apple’s Standard End User License Agreement.

By purchasing, activating, renewing, or using a KIRU+ Pro subscription, you acknowledge that you have read, understood, and agreed to these Subscription Terms.

1. KIRU+ Pro Subscription Service

KIRU+ Pro is a premium subscription service that may provide access to advanced educational content, premium medical learning tools, clinical study resources, artificial intelligence-assisted educational features, simulation tools, professional development resources, and other exclusive functionalities designed for healthcare professionals, medical residents, medical students, and users interested in medical education.

KIRU+ Pro is intended for educational and professional learning purposes only. It does not provide medical diagnosis, individualized medical treatment, emergency medical guidance, prescription recommendations, or patient-specific clinical decision-making.

2. Available Subscription Plans

KIRU+ Pro may offer auto-renewable subscription plans, including:

KIRU+ Pro Monthly Subscription
Access period: One month
Price: Displayed in the App before purchase confirmation.

KIRU+ Pro Annual Subscription
Access period: One year
Price: Displayed in the App before purchase confirmation.

Prices may vary by country, region, currency, tax treatment, App Store territory, promotional availability, and Apple account settings. The final price, billing period, renewal terms, and applicable taxes will always be displayed by Apple before you confirm the purchase.

Any prices shown in marketing materials, if any, are for reference only and may differ from the final price displayed in your Apple purchase confirmation screen.

3. Auto-Renewable Subscription Disclosure

KIRU+ Pro subscriptions purchased through the iOS App are auto-renewable subscriptions processed by Apple through Apple’s In-App Purchase system.

By purchasing a KIRU+ Pro subscription through Apple:

Payment will be charged to your Apple ID account at the time you confirm the purchase.
Your subscription will automatically renew unless auto-renewal is turned off at least twenty-four (24) hours before the end of the current subscription period.
Your Apple ID account may be charged for renewal within twenty-four (24) hours before the end of the current subscription period.
The renewal charge will correspond to the subscription plan you selected, unless changed in accordance with Apple’s rules and applicable law.
You may manage, modify, or cancel your subscription through your Apple ID account settings after purchase.
Deleting the App does not cancel your subscription.
Canceling your KIRU+ account does not automatically cancel your Apple-managed subscription.
Cancellation takes effect at the end of the then-current billing period.
You will continue to have access to KIRU+ Pro until the end of the active paid subscription period, unless otherwise required by Apple or applicable law.

4. Subscription Management and Cancellation

You are solely responsible for managing your Apple-managed subscription through your Apple ID account.

To manage or cancel your subscription on iOS:

Settings > Apple ID > Subscriptions > KIRU+ Pro

You may also manage subscriptions through Apple’s official subscription management tools.

KIRU+ cannot directly cancel, pause, refund, downgrade, upgrade, or modify subscriptions billed through Apple outside of the mechanisms provided by Apple.

If you cancel a subscription, your access to KIRU+ Pro will remain active until the end of the current paid billing period. After that period ends, your account may be downgraded to the free version of the App or to the access level available without an active subscription.

5. Free Trials, Promotional Offers, and Introductory Pricing

KIRU+ Pro may, at its discretion and subject to Apple’s availability and approval, offer free trials, introductory pricing, promotional offers, or limited-time access programs.

If a free trial is offered:

The duration of the free trial will be displayed before purchase.
The subscription may automatically renew as a paid subscription at the end of the trial unless canceled at least twenty-four (24) hours before the trial period ends.
Any unused portion of a free trial may be forfeited when you purchase a KIRU+ Pro subscription, where permitted by Apple’s policies and applicable law.
Eligibility for free trials or promotional offers may be limited to new subscribers, specific regions, specific plans, or other criteria determined by Apple or KIRU+.

KIRU+ reserves the right to modify, suspend, or discontinue promotional offers at any time, subject to Apple’s rules and applicable law.

6. Premium Features and Access

An active KIRU+ Pro subscription may unlock premium features, which may include, without limitation:

Premium educational content.
Advanced medical learning resources.
Clinical summaries and study modules.
Simulators and academic tools.
AI-assisted educational features.
Voice or text-based learning tools.
Exclusive updates and premium-only content.
Personalized learning experiences.
Other features displayed in the App.

Feature availability may vary over time, by country, by device, by operating system version, by subscription status, by technical availability, or by compliance requirements.

KIRU+ may update, replace, improve, remove, limit, or modify premium features at any time, provided that such changes comply with applicable law and platform rules.

7. No Medical Advice

KIRU+ Pro does not provide medical advice.

All content, simulations, AI-generated responses, summaries, academic modules, clinical references, or educational tools are provided for general informational and educational purposes only.

KIRU+ Pro must not be used as a substitute for:

Professional medical judgment.
Direct physician-patient evaluation.
Emergency care.
Hospital protocols.
Institutional clinical guidelines.
Specialist consultation.
Applicable laws, regulations, or professional standards.

Healthcare professionals remain fully responsible for their clinical judgment, professional decisions, and compliance with applicable medical, ethical, institutional, and legal obligations.

8. Artificial Intelligence Disclaimer

KIRU+ Pro may include artificial intelligence-assisted tools. AI-generated outputs may be inaccurate, incomplete, outdated, biased, or unsuitable for a specific user, patient, case, or clinical context.

You agree that:

AI-generated content is for educational support only.
AI outputs must be independently verified.
AI outputs must not be used as the sole basis for clinical, diagnostic, therapeutic, legal, financial, or safety-critical decisions.
KIRU+ does not guarantee the accuracy, completeness, timeliness, or clinical applicability of AI-generated information.

9. License Grant

Subject to your compliance with these Subscription Terms, the KIRU+ Terms and Conditions, Apple’s applicable terms, and payment of applicable subscription fees, MedSurgery Store For Digital Health S.A.S. de C.V. grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use KIRU+ Pro features during the active subscription period.

This license is for lawful personal, academic, educational, and professional learning purposes only.

No ownership rights are transferred to you.

10. Restrictions

You agree not to:

Share, resell, sublicense, distribute, or commercially exploit KIRU+ Pro access.
Circumvent subscription, payment, authentication, or access controls.
Copy, scrape, reproduce, extract, or redistribute premium content without authorization.
Use KIRU+ Pro to provide unauthorized medical, legal, or professional advice.
Upload patient-identifiable information unless legally authorized and expressly permitted.
Use the App in a way that violates laws, professional standards, institutional rules, privacy obligations, or third-party rights.
Reverse engineer, decompile, modify, or attempt to derive the source code of the App.
Abuse, overload, attack, or interfere with KIRU+ systems or third-party services.

Violation of these restrictions may result in suspension or termination of access without refund, where permitted by law.

11. Account Status, Expiration, and Loss of Access

If your subscription expires, is canceled, fails to renew, is refunded, is revoked by Apple, or cannot be validated, KIRU+ may limit or remove access to KIRU+ Pro features.

Your account may continue to exist with free or limited access, but premium features may become unavailable.

KIRU+ may rely on Apple, RevenueCat, StoreKit, or other authorized systems to validate subscription status.

Access restoration may require using the “Restore Purchases” functionality, signing in with the same Apple ID used for purchase, or following Apple’s official subscription recovery processes.

12. Restore Purchases

If you purchased KIRU+ Pro through Apple and later reinstall the App, change devices, or lose access, you may restore your purchase using the “Restore Purchases” option within the App.

Restoration depends on Apple’s purchase records, your Apple ID, subscription status, App Store availability, and network connectivity.

KIRU+ cannot restore purchases that Apple does not validate.

13. Refunds

For subscriptions purchased through Apple In-App Purchase, all billing, refund requests, chargebacks, and payment disputes are handled by Apple in accordance with Apple’s policies and applicable law.

KIRU+ does not control Apple’s refund approval process.

To request a refund, users must use Apple’s official refund process.

If Apple grants a refund, KIRU+ may revoke or limit access to KIRU+ Pro features associated with the refunded transaction.

14. Taxes, Currency, and Regional Pricing

Subscription prices may include or exclude taxes depending on your jurisdiction, Apple account settings, App Store territory, and applicable tax regulations.

Apple may determine local pricing, tax collection, currency conversion, and payment processing terms.

KIRU+ is not responsible for currency fluctuations, foreign transaction fees, bank charges, App Store regional pricing differences, or taxes collected by Apple.

15. Changes to Subscription Pricing or Plans

KIRU+ may change subscription prices, plans, included features, or subscription structure from time to time.

Where required, Apple will notify you of price changes, and your consent may be required before a new price takes effect.

If you do not agree to a price change, you must cancel your subscription before the change becomes effective.

Continued use of KIRU+ Pro after a valid renewal at the updated price constitutes acceptance of the updated subscription terms.

16. Third-Party Terms

Subscriptions purchased through Apple are subject to Apple’s applicable terms and conditions.

If there is a conflict between these Subscription Terms and Apple’s applicable mandatory terms for Apple-managed purchases, Apple’s applicable terms will control solely with respect to Apple billing, purchase processing, refunds, subscription management, and App Store account-related matters.

17. Physical Goods and External Checkout

KIRU+ may include access to or links for physical goods, including medical apparel, educational materials, instruments, accessories, or other physical products.

Physical goods are separate from KIRU+ Pro digital subscriptions.

Digital subscriptions and premium in-app digital content are processed through Apple In-App Purchase on iOS.

Physical goods may be purchased through external websites or third-party checkout systems. Such purchases are governed by the applicable external store terms, shipping policies, refund policies, warranty terms, and privacy policies.

KIRU+ Pro subscription fees do not include physical goods unless expressly stated.

18. Service Availability

KIRU+ Pro features may depend on:

Internet connectivity.
Apple services.
App Store availability.
Subscription validation systems.
Cloud infrastructure.
Third-party providers.
Device compatibility.
Operating system version.
Regional availability.
Legal and regulatory restrictions.

KIRU+ does not guarantee uninterrupted or error-free access to KIRU+ Pro.

19. Disclaimer of Warranties

To the maximum extent permitted by applicable law, KIRU+ Pro is provided on an “as is” and “as available” basis.

MedSurgery Store For Digital Health S.A.S. de C.V. does not warrant that:

KIRU+ Pro will be uninterrupted, error-free, or permanently available.
Educational content will always be complete, accurate, updated, or suitable for a specific purpose.
AI-generated responses will be accurate, complete, or clinically applicable.
The App will satisfy all professional, academic, institutional, or clinical requirements.
Third-party services will remain available or error-free.

Nothing in these Subscription Terms limits rights that cannot be waived under applicable consumer protection laws.

20. Limitation of Liability

To the fullest extent permitted by applicable law, MedSurgery Store For Digital Health S.A.S. de C.V., its directors, officers, employees, contractors, licensors, affiliates, service providers, and partners shall not be liable for indirect, incidental, consequential, special, punitive, exemplary, or loss-of-profit damages arising from or related to:

Use or inability to use KIRU+ Pro.
Subscription access failures.
Apple billing issues.
AI-generated content.
Educational content.
Clinical misuse.
User reliance on App content.
Third-party service interruptions.
Loss of data.
Unauthorized account access.
External checkout issues.
Device, network, or operating system failures.

This limitation applies regardless of legal theory, including contract, tort, negligence, strict liability, warranty, or otherwise, to the maximum extent permitted by law.

21. User Responsibility

You are responsible for:

Reviewing subscription terms before purchase.
Confirming the correct plan, duration, and price before purchasing.
Managing cancellation through your Apple ID account.
Maintaining access to your Apple ID.
Keeping your account credentials secure.
Using KIRU+ Pro lawfully and professionally.
Verifying educational, medical, and AI-generated content before relying on it.
Complying with applicable laws, institutional rules, and professional obligations.

22. Termination of Premium Access

KIRU+ may suspend, restrict, or terminate premium access if:

Your subscription expires or is canceled.
Apple cannot validate your subscription.
Payment fails.
A refund or chargeback is issued.
Fraud, abuse, or misuse is detected.
You violate these Subscription Terms.
Required by law, Apple policy, or platform requirements.

Termination of premium access does not automatically delete your KIRU+ account unless you separately request account deletion.

23. Account Deletion and Subscription Cancellation

You may request deletion of your KIRU+ account through the App or by contacting:

However, deleting your KIRU+ account does not automatically cancel your Apple-managed subscription.

You must cancel your subscription separately through your Apple ID account settings.

If you delete your account while your subscription remains active, you may lose access to App-based features unless you restore your purchase or create/recover an eligible account, subject to Apple validation and KIRU+ technical limitations.

24. Governing Law

These Subscription Terms are governed by the laws of Mexico, without prejudice to any mandatory consumer protection, privacy, digital services, or platform rights that may apply in your jurisdiction.

Where legally permitted, disputes shall be submitted to the competent courts of Mexico.

Nothing in these Subscription Terms limits non-waivable rights available to consumers under applicable law.

25. Amendments

KIRU+ may update these Subscription Terms from time to time.

Material changes may be communicated through the App, website, email, or other reasonable means.

Continued use of KIRU+ Pro after updated Subscription Terms become effective constitutes acceptance of the revised terms.
